Anti-Crisis Shield in practice - video chat with a WOT lawyer

On April 10, 2020, the Warsaw Tourism Organization organized a video chat with a law firm for its members on the practical application of the provisions of the Anti-Crisis Shield for tourism entrepreneurs. During the online meeting, the Office of Legal Counsel Edyta Łasicka was represented by Legal Counsel Edyta Łasicka and Legal Counsel Agata Puchała, who answered questions previously submitted by WOT members.

  1. Is stand-by pay for an employee employed under a contract of mandate a one-off benefit and if not, what does one need to do to receive it more than once?
  2. How can a company that does not employ full-time employees apply for a loan?
  3. Can employee salary subsidy be obtained for the period April-May-June instead of February-March-April?
  4. Does a concert agency (organization of concerts and cultural events) qualify as a cultural institution for aid? If so, what kind?
  5. Due to the postponement of PIT4 advance payments for March and May until June 1, 2020, is it necessary to submit additional applications?
  6. Which benefits can be combined and which cannot (standstill allowance, co-financing of business costs, care allowance for a child up to 8 years of age)?
  7. Is it possible to submit several applications for mutually exclusive benefits at the same time (e.g. job protection, wage subsidy, exemption from ZUS) and, as the decision is received, withdraw from the conflicting benefits?
  8. Can people on economic downtime or working reduced hours collect current or outstanding vacation leave during this time?
  9. By reducing the working hours of employees, does a micro-entrepreneur lose the opportunity to apply for loan cancellation?
  10. Does the funding that an employer receives from the Guaranteed Employee Benefits Fund remain in its budget as a subsidy for the remuneration already paid to the employee or does the employer pay the received benefit to the employee?
